5User Content and Data
5.1 Ownership
You retain full ownership of all data, documents, images, and other content that you upload, submit, or store through the Service ("User Content"). HCFX does not claim any ownership rights over your User Content.
5.2 License to HCFX
By uploading User Content to the Service, you grant HCFX a limited, non-exclusive, worldwide license to store, process, display, and transmit your User Content solely for the purpose of providing and improving the Service. This license terminates when you delete your User Content or close your account, except as required for backup and disaster recovery purposes.
5.3 Data Security
HCFX employs industry-standard security measures to protect your User Content, including encryption in transit and at rest, regular security audits, and access controls. However, no method of electronic storage or transmission is completely secure, and we cannot guarantee absolute security.
5.4 Data Portability
You may export your User Content at any time through the Service's export functionality. Upon account termination, HCFX will make your data available for export for a period of thirty (30) days, after which your data may be permanently deleted from our systems.
5.5 Data Processing
HCFX may process your User Content in aggregated and anonymized form for the purpose of improving the Service, generating industry insights, and developing new features. Aggregated data will not identify you or your property individually.
6The HCFX Property Record
HCFX is designed as a property-centric platform. Certain data held by the Service is maintained at the property level — that is, it is associated with a physical address rather than with any individual user account. This section describes how that data is handled, why it persists, and your rights with respect to it.
6.1 What is the Property Record
For each physical property registered on the Service, HCFX maintains a Property Record: a durable, curated collection of documented events and supporting evidence associated with that property. The Property Record may include, without limitation, recorded events such as permits, inspections, repairs, replacements, installations, warranty registrations, service visits, invoices, receipts, professional reports, and photographic documentation, together with their dates, parties involved, materials, costs, and source documentation.
The Property Record is distinct from your personal account and from user-generated commentary (such as reviews, opinions, or forum posts). Those materials are treated as User Content under Section 5 and as user speech under Section 7 (Acceptable Use).
6.2 Why the Property Record persists
The Property Record is maintained as a continuous chain-of-custody record of events that have occurred at a property. Its purpose is to support trustworthy property history — for homeowners, renters, contractors, inspectors, insurers, lenders, future buyers and sellers, and other parties with a legitimate interest in the property's documented condition and history. This function is analogous to other records-custodian services, including vehicle history records, title records, public permit records, and professional inspection databases.
Accordingly, the Property Record is maintained across changes in ownership, tenancy, user account status, and subscription tier. By submitting documentation to the Service that pertains to a property, you acknowledge and agree that (a) the documented event becomes part of that property's Property Record, (b) the event may be accessed by current and future authorized users of that property, and (c) the event will be retained as a fact of the property, subject to the dispute and correction procedures described below.
6.3 Verification tiers
Entries in the Property Record are labeled according to their evidentiary basis:
- Verified. Entries backed by primary- source documentation, such as an invoice, permit, inspection report, manufacturer warranty registration, or photographic evidence with verifiable metadata. Verified entries are maintained as documented facts of the property.
- Unverified. Entries submitted without primary-source documentation, such as a user-reported maintenance event without a receipt. Unverified entries are attributed to the submitter and labeled as such on the Property Record.
- Disputed. Entries for which a party with a legitimate interest has submitted conflicting documentation or a good-faith challenge to accuracy. Disputed entries are marked visibly on the Property Record pending resolution.
6.4 Dispute and correction process
Any party with a legitimate interest in a Property Record entry — including the current property owner, a prior owner, a named contractor, or any other party directly referenced in the entry — may challenge the accuracy of that entry. Challenges must be submitted through the Service's dispute process and must include supporting counter-evidence or a reasoned basis for the challenge.
Upon receiving a good-faith challenge, HCFX will review the evidence, mark the entry as Disputed pending resolution, notify the original submitter where reasonably possible, and make a reasonable determination based on the available evidence. HCFX may amend, annotate, mark as corrected, or — where the entry is demonstrably false or unsupported — remove the entry.
6.5 Your personal information vs. the Property Record
Your personal information (including your name, contact details, account credentials, and payment information) is subject to our Privacy Policy and to your rights under applicable privacy laws, including the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), and other applicable laws. You may exercise your privacy rights — including the right to access, correct, export, and delete your personal information — as described in our Privacy Policy.
However, property-level facts documented in the Property Record (for example, "a roof replacement occurred at this address on [date] by [contractor] for [cost], documented by [invoice]") are records of property events, not records of you as an individual, and are maintained as part of the documented history of the property. Where technically feasible and consistent with applicable law, HCFX will disassociate deleted or anonymized user identifiers from the underlying Property Record entries rather than erase the property-level event itself.
HCFX believes in good faith that maintaining Property Record entries in this manner is consistent with applicable privacy law, which provides for the retention of records necessary for the establishment, exercise, or defense of legal claims, for compliance with legal obligations, and for legitimate interests in durable property records, subject to appropriate safeguards.
6.6 Transparency and provenance
Each Property Record entry displays its provenance — including its verification tier, submission date, submitting party (or an anonymized reference), and supporting documentation, to the extent such information is available and appropriate to display. Disputed and corrected entries are visibly labeled.
6.7 Reliance on the Property Record
Property Record entries are maintained in good faith based on information submitted by users and, where applicable, verified against primary-source documentation. The Service is not a substitute for professional inspection, legal advice, or due diligence. Parties relying on the Property Record for transactional, insurance, lending, regulatory, or similar purposes should independently verify entries of material consequence.
9Third-Party Links and Non-Affiliation
9.1 External Links
The Service may contain links to third-party websites and services, including but not limited to Zillow, Redfin, and Realtor.com. These links are provided solely for your convenience and informational purposes. HCFX does not control, endorse, or assume any responsibility for the content, privacy policies, or practices of any third-party websites or services.
9.2 Non-Affiliation
HCFX is not affiliated with, endorsed by, or sponsored by Zillow, Redfin, Realtor.com, or any other third-party service linked from the platform. Any trademarks, service marks, trade names, or logos displayed in connection with third-party links are the property of their respective owners. The inclusion of any link does not imply a partnership, joint venture, or other relationship between HCFX and the linked third party.
9.3 No Warranty on Third-Party Content
HCFX makes no representations or warranties regarding the accuracy, completeness, reliability, or timeliness of any information available on third-party websites accessed through links on the Service. You acknowledge and agree that HCFX shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any content, goods, or services available on or through any third-party website.
9.4 Your Responsibility
Your interactions with any third-party website or service, including payment and delivery of goods or services, and any other terms, conditions, warranties, or representations associated with such dealings, are solely between you and the third party. You should review the terms of service and privacy policy of any third-party website before providing any personal information or engaging in any transaction.
11Limitation of Liability
11.1 Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. HCFX does not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected.
11.2 Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall HCFX, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of, or inability to access or use, the Service; (b) any conduct or content of any third party on the Service; (c) any content obtained from the Service; or (d) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.
11.3 Cap on Liability
In no event shall HCFX's total liability to you for all claims arising out of or related to these Terms or the Service exceed the amount you have paid to HCFX in the twelve (12) months immediately preceding the event giving rise to the claim, or one hundred dollars ($100), whichever is greater.
11.4 Not Professional Advice
The Service is a home management tool and does not provide professional advice. HCFX is not a licensed contractor, inspector, engineer, or real estate professional. Any information provided through the Service, including maintenance recommendations and system lifecycle estimates, is for informational purposes only. You should always consult qualified professionals for specific home maintenance, repair, or improvement decisions.
